A scenario for the early 1900's. A couple marry and have three children. Husband dies. Does his wife need his Will/Probate to inherit? Then wife dies leaving three 'minor' children. Who inherits? If there is no Will will there be Probate?

Which country?
If it's England you can check what happened. The National Probate Calendar is available on Ancestry for this period.

Yes, it is England. I have a 1913 death but there is no corresponding Will/Probate in the NPC on Ancestry. I was hoping to use the NPC to pin down the death of the widow but nothing looks likely. As she was a widow with three young childen I'm presuming her father took charge and would, surely, have needed Probate.

If there was only a small estate, it wouldn't be necessary to apply for probate.
