I would like to thank everyone that has put so much research into this.
I apologise for my non response for so long. I had paused my research and when I picked it up, I could not recall which site I had logged into. It was only by chance I googled "Private adoption in England 1890" today and this thread popped up. I'm gob-smacked.
Re: the spelling of his surname, we have always wondered if it was a letter E on the end of it. I have conducted searches using Herberte, Herberts, Herbert.
I have since done my DNA and I'm non the wiser but do have list of people now that I have a DNA link and by process of elimination I know are from my paternal side.
I did find last year that he had died 28 February 1945 in Archway Hospital, Islington (interesting that Islington was mentioned in an earlier reply). He was using the name William Herbert. He was interred in Islington Cemetary, grave reference Z/17539.
